PREAMBLE

SARL Les Jardins des Balisiers offers short-term furnished tourist accommodation for rent. These General Terms and Conditions of Sale (GTC) define the terms and conditions for reservation, payment, cancellation, stay, and mutual commitments. The issuance of a quote, followed by partial or full payment and acceptance of the GTC, constitutes a contract between the parties. 1. RESERVATION AND PAYMENT TERMS

All reservations are validated:

- By paying a 50% deposit if the reservation is made more than 31 days before arrival;

- By full payment (100%) if the reservation is made 30 days or less before the start of the stay.

Any remaining balance must be paid no later than 30 days before arrival.

Accepted payment methods: bank transfer, ANCV holiday vouchers (paper and e-connect), credit card and all payment methods offered online via the website https://www.lesjardinsdesbalisiers.com/

2. RESERVATION CONFIRMATION

The reservation is considered final upon receipt of payment in accordance with the terms above, and after acceptance of these General Terms and Conditions. The invoice or voucher sent constitutes the rental contract.

3. CONDITIONS OF CANCELLATION BY THE CUSTOMER

- More than 31 days before arrival: the deposit remains acquired.

- 30 days or less before arrival: the entire stay is due.

- No-show or early departure: no refund.

- If no news is received from the tenant within 24 hours of the scheduled arrival date, the reservation is considered cancelled. The sums paid remain with the Seller, who will regain full use of the premises and may dispose of them freely, without any obligation to reimburse or rehouse.

4. CONDITIONS OF CANCELLATION BY THE SELLER

In the event of cancellation of the stay at the initiative of the Seller, the sums paid as a deposit will be refunded in full.

In accordance with Article 1590 of the Civil Code, the Seller will be required to return to the Customer double the deposit received, except in cases of force majeure.

Any unforeseeable, irresistible and external event making the performance of the contract impossible is considered a case of force majeure, in accordance with Article 1218 of the Civil Code.

5. ARRIVALS AND DEPARTURES

Arrival: between 4 p.m. and 9 p.m. Any late arrival must be reported and accepted by the Seller.

Check-out: before 12:00 p.m. Late check-out is available upon request and subject to availability, with an additional charge.

6. USE OF THE PREMISES

These premises are intended for relaxation. Parties, noisy evenings, noise pollution, and deep-frying are prohibited.

The accommodations are non-smoking indoors. Smoking is permitted outside with respect.

7. CAPACITY

The number of people allowed is the number indicated in the contract. Any unauthorized excess may result in immediate cancellation of the stay.

8. ANIMALS

One pet is allowed per accommodation. Service animals are accepted without restriction.

9. INSURANCE AND LIABILITY

The customer is responsible for any damage caused in the accommodation or outdoor areas. It is recommended to have holiday liability insurance.

10. SERVICES INCLUDED IN THE PRICE

- Furnished and equipped accommodation

- Private swimming pool (except for accommodation without a swimming pool)

- Access to the tropical garden

- Water, electricity, gas, internet (wifi)

- Household linen (renewed every 7 days)

- Equipment: table, iron, vacuum cleaner, small household appliances (kettle, coffee maker, toaster, etc.)

11. TOURIST TAX

In accordance with the regulations in force established by the Communauté d'Agglomération de la Riviera du Levant (CARL) , a tourist tax is collected for any night spent in furnished tourist accommodation.

This tax:

Is calculated based on the classification of the accommodation (declared or classified furnished tourist accommodation);
Applies only to adults ;
Is collected by the Seller on behalf of the local authority;
Not included in the displayed booking rates.

It is due in full by the Customer and is paid either online when booking or on site upon arrival .

12. ADDITIONAL OPTIONS (ON REQUEST)

The following services can be added to your reservation, subject to availability and upon express request:

Intermediate cleaning: €90
Breakfasts and meals served in the villa
Wellness services: massages, treatments
Late check-out, subject to availability

13. SECURITY DEPOSIT

A security deposit of €600 is required. This can be paid by check or direct debit authorization (credit card imprint).

This deposit covers damage, loss or repair costs.

In the absence of damage, it is returned within 7 to 10 days after departure.

In the event of damage being noted, an amount will be withheld upon presentation of supporting documents. The tenant agrees to pay any excess amount if necessary.

14. INVENTORY AND REPORTS

The customer has 24 hours after arrival to report any problems or non-conformities noted in the accommodation.

An exit inventory is carried out at the end of the stay or within 72 hours.

In the absence of any dispute or if no damage is noted, the guarantee is automatically returned.

15. RIGHT OF WITHDRAWAL

In accordance with article L221-28-12 of the Consumer Code, accommodation services provided on a specific date are not subject to the right of withdrawal.

Wellness gift cards can be canceled within 14 days of purchase.

17. APPLICABLE LAW

The contract is subject to French law. Any dispute shall be brought before the courts of Pointe-à-Pitre.
